Laid off Roush Fenway crewman sues team over contract dispute

A former Roush Fenway Racing fabricator and over-the-wall crew member is suing the team for money he alleges he is owed for being laid off prior to the completion of his three-year contract.
 
Nick Bailey, signed a three-year deal in October 2006 to run through the 2009 season, according to the complaint and portions of his contract filed recently in North Carolina Superior Court in Charlotte.
 
He initially worked in the Truck shop at Roush as well as on the pit crew for the No. 16 Nationwide team. He was then transferred to Roush’s ARCA team in April 2008.
 
At the time he was laid off Nov. 10 , 2008, his base salary was $1,050 per week, according to the complaint. He also was eligible for bonuses depending on the performance of the team and the pit crew.
 
Bailey is asking for $63,000 – his salary from Nov. 10, 2008 through Dec. 31, 2009 – and for whatever bonuses it is determined he deserves.
 
Roush Fenway Racing President Geoff Smith confirmed that Bailey had been laid off as part of a reduction in the company work force but declined further comment.

    A contract should be a contract binding on both parties. If you owe the guy $63,000 why lay him off ?? Let the guy work and contribute. I can't believe Jack treated someone like this.

    NASCAR teams lived high on the hog but it's over and they will have to come back down to reality. Private jets and yachts, are we talking about NASCAR or the big 3 auto makers who now both need money. Both were spending and partying over there means. Now we can start over and hope there will be 30 teams for the 1st race at Daytona 2009 with sponsorhip. If Bailey had a contract he will get his money. Let's hope our politicians don't give the big three our tax paid money.

    There will be plenty of cars for Daytona, probadly around 47 to 49. The race pays 250,000.00 just to start. its after that that everyone is worried about.

    It's funny to me that contracts seem to be a one way event. Naturally I don't know all the particulars but I see what everybody else sees and reads. i.e. Take Bobby Labonte, and his 4 year contract, was that just a piece of tissue? It seems that what is good for the company automatically supercedes the wants of the ones doing the job. Good luck to you Mr. Bailey and I hope Mr. Roush has something nice for you in your Christmas stocking this year.

    Yeah, Werner, your math is off. You're not doing the '09 season he's asking for. I had no idea those guys make that much. I have years of schooling, and hands on experience, not to mention racing experience. I'd do his job for less. Maybe he should think about that. MANY people would do his job for less just to have the chance to tour with NASCAR. If anyone in NASCAR is reading, my name is posted. PLEASE give me a shop job.

    here's the way i see it: mr. bailey was injured while participating in pit practice. after undergoing surgery on his shoulder he was reassigned from the truck shop to the arca dept, then released from roush fenway due to "the lack of work"...we did not read any of this in the headlines. since his initial contract was with the truck team it should be honored regardless of the arca team's status
