Richard Childress Racing has filed a lawsuit against an Illinois-based company that sells photos and posters of drivers.
RCR filed the suit against Majestic Mountain Marketing, which operates Pro Sports Images and the Web site prosportsimages.com. The suit alleges trademark infringement on the No. 3, 29 and 31 stylized marks.
RCR asks for the company to stop selling the photographs and posters and for proceeds from the sales already made.
The lawsuit was filed July 1 in U.S. District Court in North Carolina.
Pro Sports Images did not respond to an email request for comment.

I am an avid Nascar fan but think they are the greediest group of crybabies on the planet. I was at a race after Dale died and was looking for a Number 3 with the wings on it that someone had designed and made the mistake of asking for it at the Dale Earnhardt trailer. That guy all but lost his mind and then made one of the stupidest remarks he could have uttered. I quote "all those people are doing are out there making money on Dale Earnhardt's name." I could not believe he could utter something so stupid when he is standing in a trailer that does nothing but makes money on Dale's good name. Dale was dead at the time. He wasn't making any of the money there off his good name. Give us a break and stop the greed. You people are ruining our sport.

I was at a race after Dale Sr passed away and was asked by a friend of mine to pick up a #3 decal with wings on it. I made the mistake of asking about it at the Dale Sr trailer and I thought the idiot working there was going to lose his mind. Then he made one of the most assinine remarks I have ever heard uttered. Now bear in mind, Dale was already dead and out comes these words of wisdom from this buffoon. I quote "those people are out there making money from Dale's good name".. well duh, and just what was he doing standing in the middle of a trailer full of merchandise he was selling at exorbinate prices but making money on his good name. He's dead, he isn't making the money on his good name. I cannot believe these organizations are that greedy and they are ruining our great sport.

Jul 15, 2008 at 3:28 PMboth of you do your homework. The style of the #3 and the signature of Dale Sr. are both trademarked/copyrighted. They can not be used without the permission of RCR/DEI. Anything you buy from a legitimate retailer will have the tag stating is was being sold with the permission from those involved. I'm sure this is true of other drivers as well.
