Sprint Cup Series Director John Darby says Robby Gordon’s successful penalty appeal won’t change the way NASCAR penalizes teams for similar infractions in the future.
Gordon’s 100-point penalty for an illegal nose was reversed by an appeals commission on Wednesday.
“I think the commission looks at the appeal on its own merits,” Darby said Friday. “Quite frankly that’s why we have that system in place.
“Am I happy when they overturned it? No. Am I discouraged or worried about defending the next appeal? No.”
Darby also discussed the 100-point penalty and 10-point Chase penalty assessed to Carl Edwards after his winning car’s oil tank lid was off after Las Vegas last week. He said the 10-point Chase penalty was something NASCAR announced it would do long ago, but this was the first time it had a chance to be implemented.
On Roush Fenway Racing’s claim that a bolt simply worked itself loose on Edwards' car, causing the lid to come off, Darby said he couldn’t worry about whether or not a team intended to cheat.
“There’s no possible way for NASCAR to look at intent,” he said.
“We just can’t do it. An appeals commission can do it. But NASCAR, there’s no way possible that we can let intent enter into the deal.”

Mar 7, 2008 at 10:12 AMI think that NASCAR would have taken the win if it had been anyone in 2nd place but Earnhart or / a Hendrick driver I also think that they should have Earnhart doesnt want to win that way the conspircy nuts would have gone crazy but 240lbs of extra down force is alot of advantage (170 oitank + 70 fender)they should have taken the win I think that it is also NASCAR 's fault when you look at the 5 penaltys from datonia of only 25 points
