CHARLOTTE – Jeremy Mayfield is a NASCAR Sprint Cup driver and owner again after U.S. District Court Judge Graham Mullen granted Mayfield’s motion Wednesday for a preliminary injunction to force the sanctioning body to lift his indefinite suspension for a test that NASCAR says was positive for methamphetamines.

After nearly two hours of testimony by NASCAR and Mayfield attorneys, Mullen found that the financial harm Mayfield is suffering by not driving is more than the potential harm to NASCAR and that Mayfield has a likelihood of success on the merits of his case.

“This is huge for us,” Mayfield said outside the courthouse. “This means more to me than any race I’ve won or anything. Thanks to all the attorneys, who worked tirelessly and endlessly.”

Mayfield, who must comply with any requests from NASCAR to drug-test him, said that he hopes to race either his own Mayfield Motorsports Inc. car or a car for another team sometime soon. Mayfield did not enter this weekend's race at Daytona International Speedway.

Since the May 9 suspension, Mayfield has said in court filings he had to lay off 10 Mayfield Motorsports employees and a sponsor has backed out of its commitments – a commitment Mayfield now hopes to get back.

“I’m happy I can go back racing and just glad the justice system works like it does and just thank God,” Mayfield said. “It might be a little late for this weekend, but we’ll see what happens. I’m able to race, that’s the main thing. … I think so now [I have a sponsor]. I have to go back and see where we stand on that and where they are.

“The main thing is to be able to go back and be able to do that. The truth came out, and now I can go back and say we’re clear of all this. I cleared my name, and now we can go racing again. That means more to me than anything.”

NASCAR can appeal the ruling to the U.S. Court of Appeals in Richmond, Va., and it can ask for Mullen’s ruling to be suspended until a hearing before the appeals court. NASCAR spokesman Ramsey Poston said that the sanctioning body would consider all options.

“We are disappointed, but we respect the judge’s ruling,” Poston said. “This is only a temporary injunction. The legal case continues beyond this point, and we will continue to make our case.”

The judge said NASCAR can test Mayfield again to see if he is a danger and noted that Mayfield is harmed by not being able to compete and earn race winnings.

“The harm to Mayfield substantially outweighs harm to NASCAR. ... Mr. Mayfield can cough up a hair sample, and we can find out from a hair sample if he is a meth head [now],” Mullen said.

Mayfield is the first driver suspended under NASCAR’s new random drug-testing policy implemented this season. He had missed the last six Sprint Cup points events.

“Independence Day for Jeremy ought to be today,” Mayfield attorney Bill Diehl said during his court presentation. “It is a case involving fairness.”

Diehl argued that NASCAR’s drug-testing procedure was unfair and that the amount of methamphetamine that NASCAR says Mayfield had in his body would have resulted in people noticing a change in Mayfield.

“The suspension … is directly caused by a drug-test result that’s done patently unfairly and eliminates [Mayfield’s ability] to show anybody that he is not a recreational drug user,” Diehl said. Later he added, “He’s either a walking zombie or he’s dead if he has that much methamphetamine in his body.”

In talking about NASCAR’s stance that it does not have to adhere to guidelines of federal agencies and that it can suspend anyone at any time in the best interest of the sport, Diehl said that NASCAR could do a “taste test” and decide if a driver has failed and that Aegis Laboratories President David Black, whose lab conducts NASCAR’s drug tests, could “take a hit” of the urine sample and decide to suspend a driver. He said NASCAR could do a litmus test and say if it comes up that it’s coffee, that NASCAR can then decide to ban coffee or chocolate milk since there is no definitive list.

“This case is not about chocolate milk or orange juice,” NASCAR attorney Helen Maher said in court. “This is about public safety. … If Mr. Mayfield is allowed to race after testing positive for methampetamines, who will protect the public? Who will protect the drivers? Who will protect the fans?”

Mayfield contends the findings resulted from a combination of prescription drug Adderall, which is used to treat attention-deficit hyperactivity disorder, and over-the-counter Claritin-D allergy medicine. NASCAR Chairman Brian France and Black have asserted that could not be the case.

Judge Mullen said there was credence to Mayfield’s claim that if he were under the influence of methamphetamines, his crew members and others would have noticed. Mayfield had his crew members sign affidavits saying they did not see any evidence that Mayfield had used drugs.

Diehl reiterated Mayfield’s position that NASCAR, because its drug policy states that tests will be done at laboratories certified by the U.S. Health Department’s Substance Abuse and Mental Health Services Administration, must follow the drug-testing guidelines required by federal agencies. Diehl said in court that NASCAR did not follow proper procedures and had no authorization to test Mayfield’s B sample and contended it should have been tested in a laboratory independent of the testing of the A sample. Mayfield has experts who have testified that the interpretation of the test results of the first test are inconclusive, and that, combined with what they said was an improper procedure with the B sample, should invalidate the entire test results.

NASCAR attorneys argued that it does not have to follow the federal workplace guidelines. NASCAR also sent the untested portion of the A and B samples to Medtox Laboratories in St. Paul, Minn., and Medtox confirmed the results of the Aegis lab.

Diehl, however,  said that because seals were broken on the A and B samples for the original tests done by Aegis, that any tests beyond the original two are invalid.

“We need some kind of way to keep it fair for everybody, and I think that’s what happened here,” Mayfield said.

Mayfield also addressed the situation around his Adderall prescription, which came from the Vitality Anti-Aging Center & Medical Spa.

“It came from my doctor, who happens to own Vitality Med Spa,” Mayfield said. “I’ve got all the reports and all the papers and have done all the tests. I’ve gone every 30 days to get checked out.”

NASCAR has countersued Mayfield for allegedly breaching his agreements with the sanctioning body, which, NASCAR says, require him to inform officials about any changes in his health (Mayfield began taking the Adderall in March) and for allegedly violating the substance-abuse policy.

NASCAR President Mike Helton and France attended the hearing Wednesday and heard the judge and Mayfield’s attorney question NASCAR’s stance that it can suspend anyone at any time at its sole discretion.

At one point, Diehl said that NASCAR’s stance that “we say it’s so and therefore it’s so” cannot be considered law.

Mayfield was the one who left feeling vindicated.

“The main thing is we can go back racing again at a NASCAR track,” Mayfield said. “We’ll see what happens.”

    If by some slim chance Mayfield is able to qualify his car this weekend, I hope the other 42 drivers arrive en masse at the infield care center pre-race for the severe flu that's going round Florida these days...or maybe it's food poisoning, or swine flu, or chicken pox...I don't want my driver, or any driver, anywhere near him...though he'd have to be dumber than a box of rocks (but that's another rant) to be anything other than 100000% virginally pure and clean this weekend.

    He will be under the microscope for sure, and if he is an abuser, he will get caught. If he's not, then it will show, too. Either way, he'll get his in the end. I wouldn't feel comfortable with him on the track if I were another driver. As my grandmother always said, "What goes on behind the devil's back will come up the front sooner or later."

    I applaud Jeremy. You know, he could be telling the truth. Why ruin a man's career and then find out he was telling the truth. He has every right to prove himself innocent. Maybe mixing two drugs together can give you a positive test result.

    You have to wonder why NASCAR isn't going to appeal this decision. Seriously, All his rights as a car owner have been reinstated like nothing ever happened. All his rights as a driver have been reinstated like nothing ever happened. Now if he can get to the track and has enough money for tires which are 1500. a set. Will NASCAR mess with him. They can do a lot to make his life miserable. The officials can make his life miserable as well as the drivers. Which by the way he hasn't got many of them in his corner because he wasn't well liked to begin with.

    Well, I am tired of it also, but I actually believe Jeremy is right. NASCAR has gotten tooo big for it's britches. You would absolutely be horrified at what some of the drugs test as. This is not the only injustice that has been decided by a faulty drug test. Theyf fare mad at him, because he did not give them a full disclosure on what he is taking. If you rinse your mouth with Listerine, you will not pass a sobriety test......

    This is kinda the result that should have been expected, if you think about all the events surrounding this case. NASCAR never tested Mayfield's hair, the drug combo he took has been shown to cause a false positive, and NASCAR obviously was harming him by not letting him race, just as the judge said.

    I hope Mayfield goes out this week and qualifies for the race, and then has a strong run. It'll be tough just getting in the race, but he can do it. NASCAR wants ultimate control of everything it's associated with, which was fine back in the day. Now though, doing so will be a quick way to start seeing your pockets weigh a little bit less. NASCAR's not able to drop everything against Mayfield and walk away- they'd lose their reputation. So, who's willing to bet that magically, Mayfield gets tested this week or something happens to whatever car he's in?

    that federal judge must have his head inthe sand. why would anyone want a driver who has adhd driving at speeds over 100 pmh on a track with drivers who are clean and aware of the responsibility of the safety of 43 other drivers.     This is not fair to the drivers who race. Don't let him back racing or being able to collect winnings. This is saying "its ok to take drugs" What kind of message our we putting out there in Nascar?? They should not have their life in danger out on that tract from drivers taking drugs whether it be Mayfield or any driver. Mayfield tested for Meth. If by any chance it was the medicines he said Claritin D and Adderall they may have effects that are not safe to be driving. And its policy and his duty to inform officials of health changes and medications. Plain and simple.

    Jeremy wont be in Daytona, at least not racing that is. Its impossible because his prepared car has to be here by 8am tomorrow. As far as Brian getting a DUI. That didn't happen. He knocked over a mailbox while trying to grab for a soda in his car and it spilled on his pants. Nothing ever happened. All drivers were tested at the beginning of the year.

    The thing I like the best about the injunction is the the judge only grants it if he feels the merits of the case suggest Jeremy will be successful in his case. While the issue is obviously not over yet, that says a lot about how strong his case is.

Their are not many people that can stomach him out here. I cant stand Rusty but I watched Jeremy spit on him one time and that was enough for me. He made smart remarks about Sr when he won Pocono and hes lucky Choc didn't kill him. As a matter of fact I posted that picture of Sr below and you can see his facial expression as he was going by VL. Jeremy said more garbage about Ray and Erin that wasn't true it was unbelievable. I met his in laws in darlington when they got drunk in the infield and smashed their golf cart into a motor home and then said they didn't do it but Jeremy would pay for the damages. the whole bunch are nothing but losers and thats why nobody wants nothing to do with him.

    NASCAR, arrogance is neither a quality nor a trait of leadership. I can appreciate having a drug testing program and applaud your reasoning for it. On the other hand the program needs to be proper and not at the whim of the owners, lab personnel, unknown procedures and suspect results.     To all you people that think you have to come on and post and post and post just to try and crucify some one because YOU dislike them need to get over it WHAT COMES AROUND GOES AROUND and sooner or later youll get yours TRUE. Just because you dislike someone does not mean all the people you try to convince are going to dislike them no matter who you are so GET A LIFE I'm sure you KNOW who are.I am one of the few who have posted to let this take its course and its NOT over but its headed in the correct direction you cannot bully people no matter who who you are.

    For the uninformed, Adderall is actually banned by EVERY single major sport and even minor sports governing body on the ENTIRE planet. It's a performance enhancing drug that if you read about the "benefits" it could be useful for a race car driver.

    Also, there's a reason the label only says to take 1-Claritin D in 24 hours. If you abuse it and take 2 the side effects are dangerous. One of those side effects is becoming extremely drowsy!

    Personally I'm indifferent. I've never really had an opinion of his skills as a driver one way or the other.

    I'm concerned that he might be abusing perfectly legal drugs and if he is, he's still a danger to other drivers and crew members.

    BTW-kids take over-the-counter cold meds containing sudafed, wash it down with Red Bull and get a buzz just like being high on illegal drugs.

    I know lots of children in elementary schools and on up are on ADD/ADHD medications mainly to help their concentration and to slow the hyper children down. I have seen really hyper children look like zombies after being on medication for ADD/ADHD. I have a sister-in-law that the Dr. put her 5 year old on adderall and he would get up in the night and start running and would be asleep. He also had night terrors as well. Of course she had the medication changed. For most children who are put on adderall or other types of medication for ADD/ADHD, their concentration and comprehension levels were a lot better. The kids grades improved as well.
