Infineon Raceway settles ADA claims

Speedway Motorsports Inc. has settled two American With Disabilities Act lawsuits with San Francisco area disabled persons’ rights advocates Richard Skaff and HolLynn D’Lil over access at Infineon Raceway.
The settlement was approved by a U.S. District Court judge in San Francisco on Friday.
According to the settlement:
• Infineon Raceway will designate 198 accessible parking spaces in its upper shops parking lot, with at least 30 spots in the lower shops parking lot that have 8-foot access aisles to support van accessible parking. For major events, signs will be posted that the spaces are exclusive for disabled persons.
• Ticket sales for accessible seating in the main grandstands, terraces and other spots will be sold by phone directly through the sales department and not online. Seats in front of the accessible seats will not be sold (so the disabled person cannot be blocked by someone standing up in front of them). If the handicapped seating is not sold by 8 a.m. the day prior to the race, the disabled persons seating and the seat in front of it may be sold.
• By 2011, the track must improve the paths of travel under the main grandstand so there is no slope greater than 6 percent.
• Motorsports Authentics also has settled with Skaff and D’Lil and agreed to offer a counter that is no more than 34 inches in height and have enough room for disabled persons to get to it and transact business.
The lawsuits were filed in 2008.
