Aric Almirola has filed a lawsuit in North Carolina Superior Court alleging that Earnhardt Ganassi Racing and Dale Earnhardt Inc. have breached their contract with him.
Almirola, who drove in seven Sprint Cup races this year for the team before his car was parked because of a lack of sponsorship, filed the complaint last Thursday. DEI had announced last year that Almirola would run a full season in 2009, but the organization later merged its Cup operation with Chip Ganassi Racing to form Earnhardt Ganassi Racing.
The complaint does not detail the circumstances surrounding the breach-of-contract claim and asks the court to refer the matter to arbitration.
Almirola had filed two notices of a claim last month, and he had until Thursday to file the actual complaint. He is dismissing his claim against Chip Ganassi Racing and EGR co-owner Teresa Earnhardt but proceeding in the one against EGR and DEI.
Almirola has 26 career Sprint Cup starts, with a career-best finish of eighth at Bristol in March 2008. He drove in 17 races in 2007 and 2008 as he shared the ride with Mark Martin in the No. 8 car at DEI.
He has driven in 14 Camping World Truck Series races this year for Billy Ballew Motorsports with six top-five finishes.
The team had no comment.

Report as AbuseIf DEI and Ganassi both officially ceased to exist when they merged, he probably doesn't have a case. If either one still existed- and I believe DEI did- then he could have a pretty solid case.

Nov 11, 2009 at 5:09 PMSo many drivers have received the shaft in deals like this over the years, but doesn't it seem like most of them happen when they jump to the cup series? Maybe if they paid their dues in a lesser series and made a name for themselves the sponsors wouldn't feel they are taking such a risk on an unknown driver. But then when opportunity knocks, you answer the door. I am not sure how a drivers union would help with teams merging and sponsor troubles. This guy would have been the smallest fish in the big pond. When your ride disappears the union isn't going to sponsor you!

Nov 11, 2009 at 7:38 PMI dont know what the fine print of a contract says and it could say alot. Many have suffered during this economic down turn. Sponsor or not and being let go, there must be some severance pay or the contract should be honored.

Report as AbuseAric did not get screwed out of the win he just got screwed out of finishing the race in the car. The person that starts the race gets the credit for the finish. You are right though it was Denny that got into the #20 Rockwell Automation ride midway through the race at the sponsors request.
